Asus has been banned from selling Zenfones in India: Know why

The Asus Zenfone is one of the top 5 selling smartphone brand from 2018. With the entry of the Zenfone Max Pro M1, Asus got the audience’s attention the Snapdragon 636 loaded device at just a price of Rs 9,999. As per a complaint by Telecare Network company, Delhi High Court has put a ban on Asus from using the Zen moniker on their products. In this article, we will tell you why this ban has been put up.

Telecare Network is a company which has been selling products in India since 2008 using the Zen trademark. Asus, which entered the Indian market in 2014 has been using this Moniker on most of their smartphones. It was not until 2018 when the Zenfone series saw a boost in sales thanks to the Zenfone Max Pro M1 and its succeeding devices like Max Pro M2 and other devices.

As per Telecare Network use of the same name “Zen” in both the company’s products might lead to confusion in the eyes of the users, so they filed a complaint in the Delhi High Court regarding the matter. The Delhi High Court has backed up Telecare Network and issued an 8 weeks notice for Asus to remove the Moniker from their devices.

What does Asus have to say on this?

As per Asus, the Zen cannot be considered as a generic mark, as it is a generic term, meaning “school of Buddhism.” Its legal team is working with Delhi High Court to resolve the issue.
